New Conservation Regulation Addresses Shark Fishing

The Alabama Department of Conservation and Natural Resources has implemented a new regulation regarding shark fishing. The regulation, signed by Commissioner M. Barnett Lawley, prohibits “chumming” or “bloodbaiting” for sharks within 300 feet of the shoreline or on a pier.
Chumming is defined as the throwing of bait or fish parts into the water to attract fish, while bloodbaiting is defined as the use of blood, chemical or synthetic attractants, fish parts, chicken parts or other animal parts to attract fish or sharks.
The regulation also makes it unlawful for any person to surf fish, bow fish or fish by any other means from any pier or beach in a manner that presents an unsafe condition to any beach goers, sunbathers, swimmers or any other person.
The Alabama Department of Conservation and Natural Resources promotes wise stewardship, management and enjoyment of Alabama’s natural resources through five divisions: Marine Police, Marine Resources, State Lands, State Parks, and Wildlife and Freshwater Fisheries. Even though it's intended to restrict dumbarses who would chum and shark fish in swimiming areas, as worded this regulation could outlaw MOST beach and pier fishing in salt or fresh water.
Maybe a few calls to Mr. Dean could have this cleared up :cussing:

That has the potential to turn any surf fishing into a crime. I have been harassed enough the few times I get to come down and surf fish every year without people actally having a law to fall back on. It has gotten to the point where I expect to be harassed at least once per trip if I am on a beach in Destin fishing between the hours of 9:30 and 5:30 about how I'm attracting sharks. I had a lady last year call the police on me while I was fishing after dark ( this was after she cussed me out and told me that low life scum like me were the reson for all shark attacks and should end up in hell to pay for the misery we had brought to the gulf coast). The cop it turned out, surf fished himself and told the lady that if she contiued to bother me then he was going to arrest her under any law he could find. I was glad e showed up that day.

Even then your not in the clear. Try this scenario on for size.
Your throwing a Gotcha and catch an undersized Spanish, that happens to be foul hooked in the gills of all places. The fish is going to die if you keep it or not. If you keep the fish you run the risk of being fined for possessing undersized fish. If you release the fish to finish off its remaining minutes of life and a shark happens along, who's to say whether the mackerel didn't draw him in.
I know that it seems far fetched, but throw in a hard case game warden and a judge who doesn't have a clue and buddy your in trouble.

That ruling prohibits pier fishing at all, for anything. If you have a fishing line or hook in the water, you have presented a hazard to any fool swimming surfing, etc, who is silly enough to enter the water near a fishing pier. As usual, some ignorant fool makes the rules. Far better to have passed a regulation prohibiting swimming, surfing, etc within 300 feet of a fishing pier.
Alas! Todays world has a new motto/truism. "Stupidity Rules!"

There are a couple of problems here. One is that the wording is so vague ("unsafe" could mean "no casting" because a fisherman could hook another person). Another is that it gives the non-fisherman beach and pier rights of way.
So animal rights activists could put an end to fishing by swimming in the area of the pier - the NEW pier - Or by standing behind a person on the pier and claiming that the fisherman is acting in an "unsafe" manner by casting his Gotcha plug at Spanish Mackeral.
Likewise, animal rights activists can shut down beach fishing by following the beach fisherman and swimming in the area wherever he goes to fish.
Blood-baiting sharks near swimmers? Stupid! The wording of the rule about "presents an unsafe condition"? Equally stupid! They should define exactly what is prohibited or leave off that section, which is covered by civil law.
